Terms of use
These terms of use govern access to and use of digital services provided by Domartech inc.
Scope
These terms apply to domartech.ca, optigest.domartech.ca, and OptiGest instances made available to customer organizations.
Acceptance
By accessing the services, you agree to these terms. If you do not agree, you must stop using the services.
Service description
Domartech provides software solutions, including OptiGest fleet management, and professional software development services.
Accounts and access
- You are responsible for safeguarding your credentials and all activity under your account.
- A valid activation code is required for initial access to a new OptiGest instance.
Acceptable use
- Services must be used in compliance with all applicable laws and regulations.
- Attempts to gain unauthorized access to systems, data, or accounts are prohibited.
- Interference with service availability, security, or integrity is prohibited.
Intellectual property
- Content, source code, trademarks, and design are owned by Domartech inc. or its licensors.
- No license is granted except the right to use the service under the subscribed plan.
User data
- Operational data entered in OptiGest remains the property of the customer organization.
- Domartech processes that data only to deliver, secure, and improve services.
Billing and subscriptions
- Pricing is shown in Canadian dollars (CAD), plus applicable taxes.
- Subscriptions are monthly and renew automatically until cancellation.
- Cancellation and, where applicable, refund terms are defined in the relevant agreement or offer.
Service availability
- Domartech makes reasonable efforts to maintain high service availability.
- Continuous 100% availability cannot be guaranteed.
- Planned interruptions may occur for maintenance, security, or improvements.
Limitation of liability
- Domartech is not liable for indirect, incidental, or consequential losses.
- Domartech’s total liability is limited to amounts paid by the customer in the previous 12 months.
Termination
- You may cancel your subscription according to the applicable terms.
- Domartech may suspend or terminate an account for violation of these terms.
Governing law
These terms are governed by the laws of the Province of Quebec and applicable federal laws of Canada.
Changes
Domartech may update these terms at any time. Updates are published on this page with their effective date.
Effective date
These terms are effective as of April 7, 2026.
